At Joey's Only Seafood Restaurants and Joey's Only Franchising Ltd., ("Joey's Only") we are committed to maintaining the privacy and security of your personal information. We take protection of your privacy seriously, and we comply with the federal privacy legislation known as the Personal Information Protection and Electronics Documents Act (the "Act") and the Canadian Standards Association's National Standard Model Code for the Protection of Personal Information. Your provision of Personal Information (as defined below) to Joey's Only means that you agree that we may collect, use and disclose your Personal Information in accordance with this Privacy Policy. If you do not agree with these terms, please do not provide any Personal Information to Joey's Only. Unfortunately, certain services can only be offered if you provide Personal Information to us. Consequently, if you choose not to provide us with any required Personal Information, we may not be able to offer you those services.

"Personal Information" means information about an identifiable individual (such as a name, address, telephone number, and e-mail address, etc.). Information such as the name, title or business address or telephone number of an employee of an organization is not considered "Personal Information".

When you fill out a Customer Comment Card, enter a Contest or Promotion or answer a Survey, we may ask for your name, birth date, address, postal code, e-mail address and phone number. Any Personal Information that you provide to Joey's Only will be used for the purpose for which it was collected. We will always inform you why we are collecting the Personal Information and if you are not comfortable with that use, please do not provide us with your information.

Your Personal Information may also be used to contact you regarding other products and services which may be of interest to you. You may opt out of such future contact, meaning you can ask us to no longer send you e-mails or direct mail. Every direct mail piece or e-mail that we send you will detail how you may opt out of being contacted.

Joey's Only will delete Personal Information that is no longer required to perform the identified purposes.

Sometimes Joey's Only receives lists of contact information for individuals who we believe may be interested in our products and services. We only obtain these lists from organizations that promise us that they have express consent to share that Personal Information with third-parties whose products and services may be of interest to those individuals. Again, if you receive correspondence from us and wish not to receive such correspondence in the future, the correspondence will detail how you may opt out of being contacted.

Each Joey's Only Seafood Restaurant which collects and uses Personal Information does so independently of any other Joey's Only Seafood Restaurant. Personal Information is not shared between Joey's Only Seafood Restaurants but may be shared between a Joey's Only Seafood Restaurant and Joey's Only Franchising Ltd., in order to fufill marketing and/or business compliance objectives.

Joey's Only does not sell, trade, or otherwise provide to third parties any Personal Information it has obtained except as described in this Privacy Policy.

Joey's Only may transfer Personal Information to organizations hired to perform services on our behalf. Personal Information will only be provided to organizations providing services to Joey's Only if they agree to use such information solely for the purposes of providing services to Joey's Only, under the instruction of Joey's Only and to act in a manner consistent with this Privacy Policy. We disclose only as much of the Personal Information as is required by these agents to perform the task they have been retained to perform.

Please note that we will release Personal Information if in our opinion we are required to do so pursuant to law (including the Act), or by a search warrant, subpoena, court order or other legal process.

Joey's Only uses its best efforts to ensure that all Personal Information it retains is accurate, complete and up-to-date.

Although Joey's Only does not collect sensitive information, we do have physical measures, organizational measures and technological measures in place to ensure protection of your Personal Information. Our security procedures are continually enhanced as new technology becomes available. Joey's Only assumes no liability for interception, alteration or misuse of information transmitted over the Internet.

Joey's Only is committed to protecting the privacy of children. For children under age 13, please do not provide any Personal Information without the knowledge and permission of your parent or legal guardian. If we learn that you are under 13, we will not retain any of your Personal Information without the consent of your parent or legal guardian.

We collect additional demographic information which will never be connected to any Personal Information you may provide. We do this in an effort to provide the highest quality of services to our clients. This data is collected in the aggregate to provide research information and trending models. For instance, we may collect just your postal code.
